These terms and conditions refer to the use of the website www.krofthome.com by users and their relationship with our brand.

The website www.krofthome.com is owned and operated by KROFT, Lda, a company with tax identification number 517471485, with registered office at Rua Rodrigo da Fonseca nº 21 C, 1250-189 Lisbon – hereinafter Kroft Home, with email contact geralkroft@gmail.com.

I. General

1.1. General conditions of use

Please read these terms and conditions of use carefully, as they govern your access to and use of this website. Anyone accessing the Kroft Home website and/or its subsidiaries (hereinafter referred to as “Kroft Home”) implicitly accepts the terms and conditions contained in these General Terms of Use. If you do not agree with the following terms, we recommend that you report the situation to Kroft Home's email address geralkroft@gmail.com and that you do not use this website. This website contains graphics, photographs, images, sample documents, artwork, texts, fonts, music, software tools and other types of information (hereinafter referred to as “content”) that are the property of Kroft Home.

Kroft Home may change or modify the website, including services and content, at any time and without prior notice. To ensure greater awareness of your rights and obligations as a User, we recommend that you consult these terms and conditions of use each time you access this website.

The User assumes responsibility for the use of this website in accordance with the rules present in these terms and conditions and in accordance with the legislation in force in Portugal, especially with regard to the rules of electronic commerce. You agree that you will not use this website to produce offensive, illegal, malicious, harmful products or material, or any other action that violates the rights of other individuals, trademarks, or companies.

Kroft Home informs the user that, by accepting these terms and conditions, they also accept the terms and conditions of the other countries in which Kroft Home operates within the European Economic Area. Furthermore, it informs that the content of the terms and conditions of all websites in countries within the European Economic Area, including these, is entirely identical, differing only in the language in which they are presented. However, in case of discrepancies between the terms and conditions of the different countries in which it operates, Kroft Home informs that the Portuguese version shall prevail.

1.2. User Conduct

By using this Kroft Home website, the User agrees to:

1. Register on the website, creating a unique profile in their own name or representing a legal entity, provided they have the power to do so, providing truthful information and refraining from creating multiple profiles or profiles in the name of third parties without sufficient powers of representation;

2. Not upload, download, publish, email, or otherwise transmit content:

2.1. that is illegal, pornographic, hate-inciting, violates laws related to child pornography and sexual exploitation of minors, allows or encourages unsafe practices that may cause physical, mental, or moral harm to children, is objectionable in racial, ethnic, social, political, legal, moral, or religious terms, or is otherwise objectionable, or infringes on the rights of third parties, including, without limitation, the rights to privacy and intellectual property protection;

2.2 that may violate any patent, trademark, trade secret, copyright, or intellectual property right or exclusive right of any person. For the avoidance of doubt, the User may only contribute works of their own authorship, therefore original works. This means that the User may not use images of celebrities or company products, nor images, texts, or graphic designs that have been copied from a particular website without the written authorization of its owner. The User may not create a "new" image or slogan using elements of images or quotes that were created by other people;

2.3 that constitutes or encourages a criminal offense or illegal activity, violates the rights of any person, or violates any national or international law or regulation;

2.4 involving the transmission of unsolicited or unauthorized advertising or promotional materials, unsolicited mail, spam, chain letters, or any other form of solicitation;

2.5 whose information is false or likely to mislead;

2.6 or any material containing computer viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any software, hardware or telecommunications equipment;

3. Do not impersonate any individual or legal entity, or misrepresent or deliberately misrepresent the User's relationship with an individual or legal entity;

4. Do not disrupt or misuse the website or any services, promotions or discounts, system resources, accounts, servers or networks or other websites linked to or accessible through our website, or compromise their security;

5. Do not use or falsify non-public areas of the site, or access them. Any User who improperly and without authorization accesses these areas of the website may be subject to legal action;

6. Do not transfer the User's Kroft Home account to another person without the prior written consent of Kroft Home;

7. Do not copy, alter or distribute rights or content of the site, services or tools, or the trademarks and copyrights of Kroft Home;

8. Do not capture or otherwise collect information about Users, including their email addresses, without their consent.

Kroft Home reserves the right to cancel any user accounts created without incurring any obligation to compensate the user, should false or abusive profiles be created regarding representation rights, or should there be abusive use of the website or promotional campaigns in effect at any given time.

Upon placing an order, the User acknowledges that Kroft Home may review the order and its content to ensure compliance with Kroft Home's guidelines and the terms and conditions of this agreement. Kroft Home does not endorse and, consequently, is not responsible for any content submitted to the site by any User, or any opinion, recommendation, or advice expressed therein. Without limiting the foregoing, Kroft Home and its designated representatives shall have the right to refuse or remove, without prior notice, any content that violates the agreement or that Kroft Home considers otherwise objectionable. In this context, the Kroft Home User agrees to analyze and bear all risks associated with the use of all their content.

The User acknowledges and agrees that Kroft Home may retain or store their information, as well as disclose it if legally required to do so, or if Kroft Home deems, according to reasonable criteria and as provided in our Privacy Protection Policy, that such retention, storage or disclosure is necessary.

The User acknowledges being responsible for all acts and communications carried out through their account. Kroft Home assumes no responsibility and cannot be held liable for content uploaded or otherwise transmitted by or to the User or to third parties. This translates into the impossibility of Kroft Home assuming responsibility or being held liable for errors, defamation, insults, slander, omissions, falsehoods, falsifications, obscenities, pornography or blasphemies that you or third parties may encounter. The User agrees to waive all claims against Kroft Home, service providers, agents, and employees for losses, damages, and injuries related to communications, content, or materials contained on the website. The User also agrees to indemnify Kroft Home for all claims and expenses, including reasonable attorneys' fees, arising from or based on the User's breach of any provision of this agreement.

1.3. Exclusive Rights

The User acknowledges and accepts that all content contained or distributed on or through the website by Kroft Home, its advertisers, or other third parties is protected by trademarks, service marks, patents, copyrights, or other exclusive rights and laws. The User may not use or distribute any content received through the website without the authorization of Kroft Home or the content owner.

The User acknowledges and accepts that the website and any software made available to or used in connection with the website contain proprietary and confidential information that is protected by intellectual property and other laws.

Subject to the User's compliance with the terms and conditions of this agreement, Kroft Home grants the User a non-exclusive and non-transferable license to use the software only as necessary to use this website, and relies on the User's commitment not to modify, rent, lease, lend, sell, distribute, or create derivative works based on the website or the software, in whole or in part.

1.4. Copyright Policy

The distinctive signs, product images, and trademarks of Kroft Home may not be used in connection with any product or service not belonging to Kroft Home, in any way that is likely to cause confusion among customers, or in any way that denigrates or harms the reputation of Kroft Home. All other trademarks not belonging to Kroft Home that appear on this website are the property of their respective owners, who may or may not be affiliated with Kroft Home, be related to Kroft Home, or be sponsored by Kroft Home.

This site and all its content are the property of Kroft Home, which holds the respective copyrights or are owned by parties who have granted Kroft Home a license to use said property.

It is expressly prohibited to retain, copy, distribute, disclose, or use the content, except in those cases stipulated in these terms and conditions of use. Kroft Home reserves the right to add, delete, or modify part(s) of the content at any time and without prior notice.

II. Kroft Home Guarantees

2.1. Termination of the Contract with Kroft Home

The User agrees that Kroft Home may, at its sole discretion, terminate this contract, including, without limitation, canceling their password, their account (or any part thereof) or their use of the site, and remove and delete any content the User has contributed to the site, at any time, with or without cause.

Kroft Home may also, at its sole discretion and at any time, cease making the site, or any part thereof, available, with or without prior notice. The User agrees that any cancellation of their access to the site under any provision of this Agreement may be made without prior notice, and acknowledges and agrees that Kroft Home may, with immediate effect, deactivate or delete their account and all related files and information found in their account and/or prevent any further access to such files from the site.

In addition, the User agrees that Kroft Home will not be liable to the User or any third party for any cancellation of the User's access to the site. If the User objects to any terms and conditions of the contract, or is otherwise dissatisfied with the website, their only recourse is to immediately cease using the website and/or cancel their account. To do so, the user must send an email with such a request to the email address: geralkroft@gmail.com.

The termination of this contract does not affect the respective rights and obligations of the parties (including, without limitation, payment obligations) that arise prior to the date of termination.

2.2. Indemnification

The User agrees to defend, indemnify, and hold Kroft Home harmless from all judgments, losses, liabilities, costs, and expenses, including, without limitation, reasonable attorneys' and experts' fees and litigation expenses arising out of, or based upon:

  • The content that the User submits, posts, or transmits through the website;
  • The User's use of the website;
  • The User's connection to the website;
  • The User's breach of contract;
  • The User's violation of third-party rights.

2.3. Disclaimer of Warranty

The User's risk of using this website rests solely with the User. This website and the information, services, products, programs, and materials available through it are provided "as is" and "as available."

The website and all its content are provided without warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability and fitness for private use or any infringement of rights. This includes, but is not limited to:

All warranties of title, or implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights;

Kroft Home makes no warranties:

  • That the website or its content will meet the User's needs;
  • That the website or service will be uninterrupted, timely, secure, or error-free;
  • That the quality of products, services, information, or other materials purchased or obtained by the User through the website will meet the User's expectations;
  • That any defects, if any, will be corrected;
  • Regarding unauthorized access to or use of our secure servers and/or personal and/or financial information stored therein;
  • Regarding any bugs, viruses, or similar issues that may be transmitted to or through our services by any third party;
  • There is a possibility that references and links to products or services of independent companies may appear on the website. These references and links are provided without warranties of any kind, whether express or implied.

The User agrees that Kroft Home will not be liable for any damages incurred by the User in connection with the website or any content on the website. The User expressly agrees that the risk of using this website, including all content, data, or software distributed by the website or downloaded or accessed from or through it, rests solely with the User. The User understands and agrees that they will assume full responsibility for all damages caused.

2.4. Limitation of Liability

Neither Kroft Home nor its officers, employees, directors, agents, suppliers, or any other party involved in the creation, production, transmission, or distribution of Kroft Home services or related services shall, under no circumstances, including, without limitation, in the case of its own negligence, be liable for any loss or compensation for direct or indirect damages, including, without limitation, compensation for loss of profits, goodwill, use, data, or other intangible losses (even if Kroft Home has been advised of the possibility of such indemnification obligations), as a result of:

  • The use or inability to use the website;
  • The cost of acquiring replacement goods and services for any goods, data, information, or services purchased or obtained, or messages received, or transactions entered into through or from the website;
  • Unauthorized access to or alteration of User transmissions or data;
  • Regarding statements or conduct of third parties on the site, or,
  • Regarding any other matter related to the site.

The User expressly acknowledges that Kroft Home will not be responsible for defamatory, offensive, or illegal content or conduct of any third party, and that the risk of injury or damage resulting therefrom rests exclusively with the User.

2.5. Promotional Campaigns

Once a purchase process is finalized, products cannot be modified nor can the order be canceled. The customer must ensure that they have correctly chosen the voucher for their purchase, being responsible for any errors if the voucher activation is not performed correctly.

In case of a complaint and need for a refund, the company reserves the right to deduct or remove the discounts applied by the campaign.

Promotional campaigns are not cumulative, meaning that the discounts and promotions of one campaign cannot be combined with others. The misuse of the website to obtain undue financial advantages, such as promotions or discounts, constitutes fraud and may result in the cancellation of the user's account, annulment of illegitimate benefits obtained, and legal action, both civil and criminal, to demand compensation for material and moral damages.

Promotional offers are valid only while displayed on the website. Kroft Home reserves the right to cancel or suspend promotional campaigns without prior notice to the customer.

2.5.1. Shipping Offer Campaign

The Shipping Offer works under the conditions presented on the website, generally taking into account the value of the order placed, and is applied at checkout, provided the requirements are met and it is valid.

This campaign may or may not be cumulative with other campaigns. If cumulative, this campaign will only apply to the net amount actually paid by the customer.

Kroft Home reserves the right to change the conditions of this campaign at any time and without prior notice.

III. Sales conditions - shipping and return policy

3.1. Order cancellation

Once a purchase process is finalized, the products cannot be modified nor can the order be cancelled. The right of withdrawal, which allows consumers to cancel distance sales contracts within 14 days of receiving the products without the need for justification or additional costs, does not apply to goods made to measure or clearly customized according to the customer's specifications.

For personalized products or goods sealed for hygiene reasons after opening, the right of withdrawal cannot be exercised. However, for products without any personalization, it is possible to request cancellation or return within 14 days of receiving the order.

Customers wishing to exercise this right in relation to non-personalized products must contact Kroft Home via customer service email or through the contact form provided on the website, providing the following information: name, address, telephone number, email address, order number, and a list of the products they wish to return.

After receiving the request, we will contact you to verify if the right of withdrawal applies to the specific case and the products in question. Instructions on the return process will also be provided. The choice of shipping method and carrier will be the responsibility of the customer, who assumes the risks and costs associated with the return.

The refund will be made within a maximum of 14 days after receiving the returned products, provided they are in perfect condition and in their original packaging. The refunded amount will correspond to the value paid for the returned products, excluding initial delivery costs and return charges.

In the case of an exchange or return due to receiving a defective item or other non-conformity, and provided the situation is verified, Kroft Home will assume the costs associated with the exchange/return process.

Because these are handcrafted products and natural materials, the customer understands that natural variations in color, texture, or grain in wood, stone, or fabrics do not constitute a defect.

3.2. Prices

Product prices are described on the website, include VAT at the current legal rate, and are originally entered in Euros. Prices and products may change at Kroft Home's discretion. Kroft Home may, from time to time, offer promotional discounts. The User must accept the terms of the promotion to benefit from the discount. The User agrees not to use more than one discount per item, unless such use is expressly permitted by Kroft Home.

3.3. Shipping

Ownership and risk of loss of all products ordered by the User are transferred to the Carrier upon shipment and are transferred to the User when they sign the proof of receipt of the ordered products. Purchases are subject to Kroft Home's shipping and return policy. Kroft Home reserves the right to cancel any product order for any reason, notifying the buyer of the order cancellation.

Kroft Home only sells items, and thus guarantees their delivery, in Mainland Portugal and the Islands (where applicable). The maximum delivery time for ordered goods is 30 days, unless otherwise agreed, from the moment the order payment is confirmed. Delivery is considered complete when the goods are physically taken by the customer, or someone representing them.

If delivery cannot be completed for reasons attributable to the customer, additional shipping costs may be charged.

Shipping times may be extended and altered depending on the volume and quantity of orders or during periods of higher order volume. The customer will be informed if any of these situations occur.

3.3.1 Access Verification

The Customer is solely responsible for ensuring that the product dimensions allow its passage through doors, corridors, stairs, elevators, and other access points at the address indicated for delivery, as well as ensuring that the property has adequate conditions for delivery (e.g., existence or non-existence of an elevator, access restrictions, condominium hours, or municipal limitations).

KROFT may request photographs, measurements, or floor plans of the delivery location in advance. The absence of information or the provision of incorrect information will be the sole responsibility of the Client.

3.3.2 Deliveries to Buildings Without Elevators

Whenever the building does not have an elevator, or the elevator is too small or not operational, delivery may:

  • Be limited to the ground floor;
  • Involve an additional cost previously communicated;
  • Require the hiring of external technical means (e.g., crane), borne by the Client.

If delivery is not possible due to structural or logistical reasons not attributable to KROFT, it will be considered a failed delivery attempt due to the Client's fault. Additional transportation costs, storage costs, and/or a new delivery fee may be charged.

3.5. Shipping Costs

The costs applied to shipping the order are the responsibility of the client, and for each order, an automatic calculation of the value is made during the checkout process, based on the products ordered and the destination region of the order, according to the pre-established table.

Delivery and Assembly - Service Notes

The Delivery and Assembly service includes:

  • Placement of items in the room indicated by the customer;
  • Removal of packaging after assembly.

Not included:

  • Hoisting through windows or balconies;
  • Fixing to walls or ceilings;
  • Electrical installations.

The customer must verify the dimensions of the products and packaging beforehand, ensuring passage through doors, elevators, stairs, corridors and access points to the delivery location.

3.6. Payment

Payments can be made via PayPal, MB, MBWAY, Credit Card, Google Pay, and Apple Pay. Payment will be transferred to Kroft Home on the order date, subject to subsequent validation.

The final price of any product will be the price shown on the date and time of the order. The User ensures that all details provided at the time of the order are correct and valid. The User guarantees that the credit/debit card has sufficient funds to cover the costs of the order.

Kroft Home reserves the right to obtain validation of the User's credit/debit card before processing any order.

The contract is only complete when the amounts are received and confirmed by Kroft Home.

Kroft Home ensures that the entire payment process is carried out with complete security.

3.7. Correction of Errors and Inaccuracies

The information and product lists appearing on this website may contain typographical errors or be inaccurate, and may not be complete or up-to-date. Therefore, Kroft Home reserves the right to correct all errors, inaccuracies, or omissions, and to change or update information at any time without prior notice (including after the User has placed their order). Note that such errors, inaccuracies, or omissions may relate to the description, prices, and/or availability of products. Kroft Home also reserves the right to limit or restrict product quantities (even after the User has submitted their order) for any reason, including, without limitation, if the product violates any terms of this agreement.

If a product is offered for sale with an incorrect price or incorrect information due to a typographical error, a pricing error, or product information that Kroft Home receives from partners, Kroft Home reserves the right to refuse or cancel orders for products listed with the incorrect price.

Kroft Home has the right to refuse or cancel these orders regardless of whether they have already been confirmed and the sale has been charged to the Customer. If the purchase has already been charged and the order is cancelled, Kroft Home will immediately issue a credit to the Customer's credit card account or refund the amount in the same way the purchase was made. If Kroft Home has overcharged for any product, it will refund the User the difference between the amount charged and the correct price of the product in question.

3.8. Invoicing

The invoice is sent to the customer via their email account once payment is made and confirmed.

3.9 Legal Guarantee and Compliance

Under Law No. 84/2021, products sold by Kroft Home have a 3-year warranty period.

In case of defect, the customer may choose:

  • Repair;
  • Replacement;
  • Price reduction;
  • Contract termination.

None of these options will represent any additional cost to the consumer.

3.10 Custom-Made and Personalized Items

Custom-made products are considered to be:

  • Items manufactured according to the customer's specific dimensions;
  • Changes to finishes, fabrics, colors or materials;
  • Products developed according to personalized specifications.

Under Decree-Law No. 24/2014, there is no right of free resolution for clearly personalized goods.

3.10.1 Deposit

For custom-made parts, a minimum deposit of 50% may be required. The deposit is non-refundable after production has begun.

3.10.2 Cancellation

After production confirmation with the supplier or commencement of manufacturing, cancellation implies:

  • Loss of the deposit;
  • Payment of costs already incurred.

3.11 Special Orders to Suppliers

Special orders are considered to be:

  • Products not belonging to regular stock;
  • Items specifically requested from the supplier at the Client's request;
  • Imported products made to order.

These orders:

  • Cannot be cancelled after confirmation to the supplier;
  • Are not returnable due to mere withdrawal;
  • Are subject to the production and transport times indicated by the supplier.

KROFT is not responsible for delays attributable to manufacturers or international carriers, provided it acts diligently.

IV. Applicable Law

All other matters relating to your access to or use of this website shall be governed by and resolved in accordance with the laws of Portugal. Any legal action or proceeding relating to or arising from your access to or use of this website shall be brought in Portugal. As a User of the website, you agree to submit to the jurisdiction of the courts of Portugal; and agree that such jurisdiction is appropriate in such legal action or proceeding. You also agree not to claim, in any legal action or proceeding involving Kroft Home, that a court of Portugal may be an inappropriate forum for such legal action or proceeding.

All matters relating to the protection, infringement or unlawful use of copyrighted materials shall be governed by and resolved in accordance with the copyright protection laws of Portugal.
